Nemours Children's Web Privacy Policy

This Privacy Policy provides information about how the Nemours Foundation (“Nemours”, “we”, “us”, “our”) may collect, use, share, or otherwise process personal information obtained through nemours.org, including its subdomains (the “Website”) and the Nemours app, accessible via our iOS and Android mobile applications (the “App”). The Website, and the App are collectively referred to in this Online Privacy Policy as the “Sites”.

Nemours also maintains a separate notice, our Notice of Privacy Practices, that applies to protected health information that we collect from individuals, including through the Sites, pursuant to the Health Insurance Portability and Accountability Act (HIPAA). View our HIPAA Notice of Privacy Practices. This Privacy Policy does not apply to our practices related to protected health information.

Collection of Personal Information

Personal Information You Provide Via the Sites. We may obtain personal information, which is information that can be used to identify you individually, from you directly when you interact with the Website and/or Blog (for example, when you donate to Nemours, subscribe to our blog, or fill out webforms). The personal information you might provide to us in this context includes your name and contact information, such as postal address, email address, and phone number. When you interact with content related to child reading readiness, you may also provide information related to your child such as their age, gender, state of residence, ethnicity/race, and reading readiness behavior.

Information Collected Automatically From the Sites. We, and the vendors we work with, may use various tools and technologies like cookies and pixels to collect certain information automatically about you when you visit certain portions of our Sites. This information may include IP addresses, pages visited, searches performed, device types, and browser information.

Cookies, pixels, and similar technologies allow certain features of the Sites to function, allow us to improve the Sites based on analytics, allow us to personalize content you interact with, enable the Sites to maintain user preferences, track the pages a user visits on the website, and identify the referral website. You may be able to adjust your browser settings to remove or reject cookies enabled on the Website. Please note that blocking these technologies may affect the availability and functionality of the Sites and other websites.

Please note that we or other parties may collect personal information about your online activities over time and across different devices and online properties when you use the Sites.

Your web browser may have settings that allow you to transmit a “Do Not Track” signal when you visit various websites or use online services. Information Collected From Other Parties. When you submit information to another party, you are subject to that party’s terms of use and privacy policies, for which we have no responsibility.

Mobile App Permissions

If you access the App via a mobile device, the App may, depending on your device and device settings, have access to device features, such as:

  1. Location (for example, may include precise or approximate location in order to map physical locations near you)
  2. Storage (the App may need access to the stored files on your mobile device in order for you to upload such files through the App)
  3. Camera (may allow the App to use your device’s camera)
  4. Microphone (may allow the App to use your device’s microphone)

By changing your mobile device permission settings, you may affect your ability to access or use certain features on the App.

Additionally, you may be able to log into the App using your device’s login features such as using a passcode or your fingerprint. These device login features are enabled through your device, not Nemours, and are subject to your device settings, preferences, privacy policies, and terms.

How We Use the Information We Collect

We may use personal information we collect through for various purposes including:

  • Providing our services (such as when you subscribe to our blog);
  • Facilitating and personalizing your user experience, including by improving our digital properties;
  • Sending marketing communications to you that we believe may interest you;
  • Monitoring and analyzing trends, usage, and activities of visitors and users;
  • Preventing, investigating, identifying, or taking any other action with regard to any suspected or actual fraudulent or illegal activity or activity that violates our policies;
  • Complying with applicable laws, rules, regulations, and legal processes as well as our company policies; and
  • For any other purpose, including at your direction.

We will store information collected via our Sites for no longer than is necessary for the performance of our obligations or to achieve the purposes for which the information was collected, or as may be permitted under applicable law.

Sharing Personal Information

We may share personal information we have obtained as described above with our affiliates, business partners, and vendors. For example, we may use service providers to help us operationally or to administer activities on our behalf, such as sending emails. In addition, we may share personal information: (1) as permitted or required by federal and state laws and regulations; (2) in the event we sell or transfer all or a portion of our business assets (e.g., further to a merger, liquidation, reorganization, or any other business transaction, including negotiations of such transactions); (3) when we determine that disclosure is necessary or appropriate to comply with law or legal process or to protect legal rights, property, or safety; (4) to enforce our policies; or (5) with your consent or at your direction.

Linked Third-Party Online Platforms

Nemours provides a number of hyperlinks that lead to other online platforms outside of the Sites, including social networks operated by unaffiliated parties. These links may also be to online services controlled and maintained by our vendors, such as donor processing vendors. The Sites may also include features and integrations that are maintained by third-party online services, such as map features. This Privacy Policy applies only to the Sites and does not apply to online services that we do not control or maintain. Please note that if you visit or interact with a third-party online service that is not operated by Nemours, that third party may collect information about you. We are not responsible for the privacy practices of other online services. You should review the terms, policies, and settings of these online services to learn more about their data practices.

Security

We take reasonable measures to protect the personal information we obtain from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. Nevertheless, transmission via the Internet and online digital storage are not completely secure, so we cannot guarantee the security of your information collected through our Sites.

Your Choices

Communication Preferences and Marketing. If you do not wish to receive marketing emails from us, you can opt out of future emails by following the instructions provided in our emails. Opting out of marketing emails will not affect our administrative emails to you.

Mobile App. You can stop all future collection of data generated by use of the App by uninstalling the App. Also, you may be able to exercise specific privacy choices, such as enabling or disabling certain features (e.g., app permissions, location-based services, or push notifications), by adjusting the permissions on your mobile device.

Note that uninstalling the App or changing your mobile app permissions for the App will not delete your user account or any information we previously collected via the App.

Information for Users Outside the United States

Please be aware that any personal information you submit will be transferred to and processed in the United States and the data protection laws and regulations that apply to your personal information may be different from the laws in your country of residence.

Revisions to This Privacy Policy

This Privacy Policy is subject to change at our discretion. We will indicate changes to the Privacy Policy by updating the “Effective Date” at the beginning of the Privacy Policy. Your continued use of the Sites after any update to this Privacy Policy will constitute your acceptance of our changes.
